Below are explanations of the document’s purpose and instructions for completing the required deed package documents.
Instructions for Execution and Notarization
Purpose:
Instructs Seller and Notary on how to complete, execute and notarize the document package. Contact information that the Notary completes is necessary in the event the Notary must be contacted due to illegible or incomplete information.
How to Complete:
Informational only for the Seller and Notary must complete, sign, date and seal each acknowledgment.
Deed
Purpose:
Used to convey or transfer title to real property.
How to Complete:
Sign, but do NOT date the deed. The Notary must sign and date each acknowledgment.
State Specific Documents
Purpose:
Any document that is necessary to transfer title that are customary for the area.
How to Complete:
See specific form.
Survey Affidavit
Purpose:
This affidavit accompanies a survey when the Seller is using an existing survey at the time of the transaction. Seller represents that no changes have been made to the property since a prior survey was completed and that no other parties have any easements or other rights to use the property.
How to Complete:
Sign and date.
Owner or Seller's Affidavit
Purpose:
This document assures the title company, underwriter and the buyer's lender that there are no off-record liens or judgments on the property, with specific reference to repairs or improvements.
How to Complete:
Answer each question and sign and date.
Limited/Special Power of Attorney
Purpose:
This document authorizes your relocation management company or its agent(s) to sign any necessary documents on your behalf to complete the sale of this specific property only.
How to Complete:
Initial (if required) where indicated, sign and date.
Notary Responsibilities
Notary Responsibilities:
- Uphold the integrity and legal validity of the notarization.
- Verify the signer’s identity.
- Ensure the signer is present and willing.
- Confirm the document’s authenticity.
- Administer the appropriate notarial act.
- Complete and affix the notarial certificate.
Notary is NOT Responsible for:
- Giving legal advice or acting as a lawyer.
- Draft or create documents
- Interpret or review documents.
- Answer document questions.
Escrow Assignment
Purpose:
This information is necessary to transfer your mortgage escrow account and is used in the event your relocation management company has to take over your mortgage payments.
How to Complete:
Complete the form, sign and date.
Authorization for Release of Information
Purpose:
This document authorizes us to contact your lender(s) for the status of your loan and/or to order a loan payoff, your homeowners association or a utility company that can place a lien on your property. If you have an Equity Line of Credit, it will be used to freeze the line in order for your relocation company to acquire the property from you.
How to Complete:
Complete the form, sign and date.
Seller's Certification of Non-Foreign Status
Purpose:
This document attests to your social security number and alien residence status. If you are not a U.S. citizen, you may need to consult your tax advisor to determine if you are a resident alien for purposes of U.S. income taxation.
How to Complete:
Complete the form, sign and date.
1099 Exemption Certificate
Purpose:
Your answers to the questions will determine if we are to report this sale to the Internal Revenue Service. This form does not have any bearing on whether or not you have a capital gain on the sale, it is used for reporting purposes only.
How to Complete:

Confidential Statement of Information
Purpose:
The information is necessary to eliminate possible judgments and liens against persons with the same or similar name to yours.
How to Complete:
Complete the form, sign and date.
Privacy Policy Notice
Purpose:
This document is a notification to you of the company privacy policy. The only personal information provided to anyone or any company is what is necessary to complete this specific transaction.
How to Complete:
Informational only.
Marital Status Affidavit
Purpose:
This document is used to determine the marital status of the seller at the time of the transaction.
How to Complete:
Complete the form, sign and date.
